Electricity: Text of Standard Conditions for Electricity Sales Contracts (TIV), Protected Categories Service, Safeguarded Service

The latest TIV (Resolution No. 156/07 AEEGSI) provides for a breakdown of customer types, with the related markets of reference. In addition to the unrestricted market, the resolution identifies two markets:  the protected categories market and the safeguarded market.

The customers qualifying as protected categories are: final retail customers; small businesses (final customers other than retail customers having less than 50 employees and annual revenues or total assets of less than €10 million), provided that when the business draws power as a small business, it does so through a low-voltage network; and final customers who hold applications related to general services used by the two preceding categories of customers. This market includes all customers meeting the aforementioned requisites who, prior to 30 June 2007, were part of the regulated market, namely, those who did not have a seller on the unrestricted market. The safeguarded service is available to all customers other those identified in the protected categories. This market includes all customers meeting the requisites of being part of the market, who, prior to 30 June 2007, were part of the regulated market, namely, those who did not have a seller on the unrestricted market.

Natural gas: Text of Standard Conditions for Gas Sales Contracts (TIVG), Protection Service

The Protection Service, as established by Resolution No. ARG/gas 64/09, guarantees the supply of gas at prices defined by the authority to the following categories of users:

– residential customers

– condominiums for residential use

– other users > 50,000 standard cubic meters per year

– public service activity (e.g. prisons, hospitals, schools)

The standard economic conditions defined by AEEGSI are identified on the basis of the actual costs of the service, and the trend of commodity prices. The Protection Service is also available to:

– companies that have not chosen their supplier;

– companies temporarily without a supplier.

The company completing the sale is required to offer the Protection Service to all customers indicated in the AEEGSI Resolution No. 64/ 09.

The price of the gas is subdivided into a distribution tariff and a sale tariff.

The tariffs are differentiated according to territorial area.

The changeover from the regulated market (protection service) to the unrestricted market is revocable.  In other words, a customer who purchases gas from an operator in the unrestricted market may cancel the contract, and apply to return to purchasing at the conditions covered by the Protected Service.
